This Fast-Food Burger Chain Is Getting Sued For Copying In-N-Out

The iconic burger chain In-N-Out is so popular that other brands want to bask in its glory, even if that involves misleading customers. The West Coast fast-food staple is suing an Australian burger chain for using its trademarked name on third-party delivery apps, which led to confusion among customers.

According to Nation’s Restaurant News, the In&Out Aussie Burgers has been accused of purposely misleading customers on Uber Eats and Menulog, two popular food ordering platforms in Australia, into believing the virtual brand was affiliated with the American chain.

The Australian company’s name features an ampersand whereas the original uses the recognizable “N” in its name. The brands’ logos are very similar, both depicting a yellow arrow and prominently featuring the color.

The bootleg brand, owned by Queensland-based RICH ASIANS pty. Ltd., doesn’t have brick-and-mortar locations and operates solely as a digital business. In-N-Out also doesn’t have restaurants in the country, but its previous limited-time pop-ups and guest appearances in the Land Down Under were enough to sow confusion among Australian customers. Experts speculate the iconic chain uses sporadic pop-ups to retain its trademark in the country which must be used once every three years.

According to local reports, In-N-Out asked the parent company to stop using the name a few weeks ago, and recently proceeded with a court filing.

“The applicant [In-N-Out Burger] has suffered loss and damage and will, if the respondents are not permanently restrained, suffer further loss and damage,” In-N-Out claims in the filings.

Several months ago, a Reddit user warned fellow burger lovers that the brand was an impostor and had no connection to the real In-N-Out.

“For those who thought it was an opportunity to try real In-N-Out Burger or that they actually finally bit the bullet and opened in Australia, nope, it’s Noodle Box,” the post read.
